FirmProfit Inc. (“FirmProfit,” “we,” “us,” or “our”), recognizes that you may be concerned about our use and disclosure of your personal information. Your privacy is very important to us, and the following will inform you of the information that we may collect from you, and how it is used. This privacy policy (the “Policy”) applies to information collected when you visit our website located at www.firmprofit.ai, www.firmprofit.co, or any mobile application or version of the website (collectively, the “Sites”). If you provide personal information to us relating to other individuals, you are responsible for communicating the terms of this Policy to them. By accessing or using the Sites, you are accepting the practices described in this Policy.
I. The Information We Collect
When you interact with us, we may collect the following kinds of information about you, which may include personal information:
- Contact information, such as your name, title, email and postal addresses, and telephone numbers;
- Additional information we may request as part of client onboarding or employee recruitment, such as a copy of your driver’s license or passport, employment history, or educational background;
- Financial information, such as your bank account details or credit card information;
- Technical information related to your usage and activity on the Sites, such as IP address, ISP, browser type, operating system and language, processor information, network type, geolocation, and data related to your use of the Sites; and
- Any other information you choose to provide to us.
II. How We Collect Your Information
1. Information you provide to us
We collect information from and about you directly when you provide it to us.
This information may be collected when you contact us, fill out a form, access or participate on our Sites, respond to surveys, or otherwise interact with us, such as through social media or networking sites.
2. Information we collect automatically
Like most online services, we automatically receive standard technical information when you use the Sites. We collect this information through browser cookies, pixel tags, web server logs, web beacons, embedded scripts, and similar technologies. These features enable us to personalize your experience on the Sites, understand how you use them, maintain a persistent session, and improve and further develop the Sites. We may also automatically collect geolocation information from your device, your wireless carrier, or certain third-party service providers (“Geolocation Information”).
3. Information we collect from other sources, including our social
media pages
We may collect personal information from users and visitors of other sites on which you have interacted with us. We will do so in accordance with the terms of use and privacy policies of those sites and applicable law. This includes our social media pages on places like Facebook, Instagram, and Twitter. For example, we may collect the information you shared on our social media pages through an application or form, which will have a link to this Policy. We may also receive personal information when you comment on our social media posts, post comments about us, or tag us in a public-facing social media post. Personal information may also be collected by the third-party social media sites that host our social media pages. These sites may provide aggregate information and analysis to us about visitors’ use of our social media pages. This Policy does not cover information collected by such third party social media sites.
4. Information we collect through third-party data and analytics providers
We use third-party data and analytics services (including as Google Analytics) to evaluate your use of the Sites, compile reports on activity, collect demographic data, enhance our data with other information about our users, analyze performance metrics, and collect and evaluate other information relating to the Sites and internet usage. These third parties use cookies and other technologies to help analyze and provide us the data, and may also collect information regarding your use of other websites, apps, and online resources, and across your electronic devices. We may also receive information about you from our marketing partners, including data brokers, such as ad campaign information (e.g., the ads you click on) or the social media platforms you use. These third-party services may also provide us with information based on inferences to better understand our users. The information used by such services is usually at the aggregate level, but may contain identifiable personal information. Please be advised that if you opt out of any service, you may not be able to use the full functionality of the Sites.
5. Tracking data
We collect tracking data using first and third-party cookies, pixels, web server logs, web beacons, and similar data collection and tracking technologies on the Sites, third-party websites, apps and online services, and across your devices (such as IP address, browser, type, ISP, platform type, device type). Third parties such as advertising networks and analytics providers may also collect information about your online activities over time and across different websites and devices when you access or use the Sites.
III. How We Use Your Information
We use your information to provide the Sites to you, and to operate our
business. This includes:
- Service-related usage: We use your information to provide and support the Sites, such as communicating with you and others, providing our services, informing you about our work, processing your requests, and maintaining our systems.
- Analyzing and improving our services: We may run calculations,
aggregate, normalize, clean, enhance, and make derivative works of the
information obtained about you in order to:- Understand and analyze usage trends and preferences;
- Monitor and analyze the effectiveness of the Sites;
- Improve the Sites and develop new services, features, and functionalities; and
- Test the Sites and our infrastructure to make sure the Sites are working correctly.
- Offering surveys or contests: From time to time, our Sites may request information via surveys or contests. Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information. We will use the contact information you provide to us in this context to notify the winners and award prizes, and use the survey information to monitor or improving the use of and satisfaction with the Sites.
- Marketing: If you enter your contact information on the Sites and opt in to receive electronic marketing communications from us, we may provide you with materials that could be useful, relevant, valuable, or otherwise of interest to you, such as marketing communications, service update and customer feedback.
- Advertising: We may use your information to tailor, analyze, manage,
report and optimize advertising you see on other sites and apps that you
access and/or use through your devices.
We may also analyze your personal information in aggregate form, which does not identify you personally (“Aggregated Data”). We may use the Aggregated Data to operate, maintain, manage, and improve the Sites, share it with our affiliates, agents, and business partners, and otherwise use and disclose it for lawful business purposes.
IV. How We Share Your Information
We may share your personal information if you ask us to do so or consent to it, as well as in in the following circumstances:
- Third-party service providers: We may disclose personal information to third parties so that they can provide us with their services. This includes professional advisers such as auditors, accountants, and local counsel; information technology, web hosting and data storage providers; and client survey and marketing services.
- Third-party counsel: We may disclose personal information to law firms or other professional advisors who represent counterparties or other relevant parties in connection with your matters.
- Protection of legal rights and safety: We may disclose your personal information to third parties in connection with claims, disputes or litigation, or if we determine its disclosure is necessary to protect the health and safety of you or us, or to enforce our legal rights or contractual commitments that you have made.
- Government or regulatory authorities: If we consider it necessary or appropriate under applicable law, we may disclose personal information in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements. We may also disclose personal information to other third parties when we reasonably believe we are compelled to do so by government authorities or required by law or regulation including, but not limited to, in response to court orders and subpoenas.
- Reorganization: If in the future FirmProfit undergoes a corporate, partnership, or business reorganization, we may transfer personal information to the surviving entity. We do not sell personal information obtained about you to any third parties, nor do we share personal information obtained about you with third parties for the purpose of marketing or cross-context behavioral advertising.
V. How We Protect Your Information
We are committed to maintaining the confidentiality, integrity and security of your personal information and take precautions to protect such information. These precautions include the adoption of physical, electronic, and procedural safeguards and procedures designed to maintain and secure your personal information from inappropriate disclosure in accordance with applicable laws and regulations. Our policies require that access to personal information be restricted to those of our partners, employees and agents who need to know that information in order to provide you with our services. If we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page. When we disclose such information to our service providers or other third parties, we require them to protect the confidentiality of your information and to use the information only for purposes for which it is disclosed to them. Unfortunately, the transmission of information via the Internet is never completely secure and we cannot guarantee the security of your personal information transmitted via the Sites. Any transmission is therefore at your own risk.
VI. How Long We Retain Your Information
We retain your personal information only for as long as necessary for the
purposes set out in this Policy, or as long as we are otherwise legally required or permitted to do so. When deciding how long to retain your information, we consider our legal and regulatory obligations, applicable data protection laws, and limitation periods for taking legal action.
VII. How You Can Modify Your Information and Communication Preferences
1. Cookies
If you do not want us to place a cookie on your hard drive, you may be able to turn that feature off on your computer or mobile device. Please consult your internet browser’s documentation for information on how to do this. However, if you decide not to accept cookies from us, certain features of the
Sites may not be fully available.
2. Geolocation information
You may control the collection of Geolocation Information through the user settings on your device. You may decline to allow us to collect such Geolocation Information, in which case we may not be able to provide certain services to you.
3. Promotional communications
You may opt out of receiving promotional communications from us by following the instructions in those communications or by contacting us as indicated below. We will use commercially reasonable efforts to process such requests in a timely manner. Please note that you cannot opt out of receiving transactional e mails.
4. Do Not Track
As mentioned above, third parties such as advertising networks and analytics providers may collect information about your online activities over time and across different websites when you access or use the Sites. Currently, various browsers offer a “Do Not Track” option, but there is no standard for commercial websites. At this time, we do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.
VIII. Children’s Privacy
The Sites are not directed toward children under the age of 18. We do not promote our services online to minors, and we do not intentionally collect any personal information from any person under 18. If we become aware of having collected personal information from children under the age of 18 without valid consent from their respective parents or guardians, we will delete it as soon as practical.
IX. External Websites
The Sites may contain links to third party websites, which may collect information about you if you click on a link. We have no control over the privacy practices or the content of these websites, and are not responsible for them. Please check the applicable third-party privacy policy and terms of use when visiting any other websites.
X. Notice To California Residents
Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the preceding calendar year, including the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. In order to submit such a request, please contact us as indicated below. Please note, however, that we do not disclose personal information to third parties for such third parties’ direct marketing purposes.
XI. Notice to Nevada Residents
If you are a Nevada resident, you have the right to submit a request directing us not to sell your personal information. Please note, however, that we do not sell consumers’ covered information for monetary consideration (as defined in Chapter 603A of the Nevada Revised Statutes).
XII. Changes to this Policy
This Policy is subject to occasional revision, without prior notice, so please review it frequently. If we make any material changes in the way we use your personal information, we will notify you by updating the effective date above, or as otherwise required by law.
